CP is not something that involves any direct harm in viewing or distributing, but it's restricted anyway under the justification that it has further externalities, a case you *could* (wrongly) make for guns
If you can void the constitution (freedom of speech) to ban a form of media, you can void the constitution (2nd amendment) to ban a type of weapon
