Natural Rights died in 1866. Natural Rights said basically that the government could not stop you from doing non-harmful things.

You could be transsexual under that system. It was up to you to figure out how to make it work.

With Civil Rights, written into law in 1866 and the Constitution in 1870, government adopted a duty to force equality.

That means compelling stores to serve transsexuals, affirmative action, etc.
