I think the logic is that most people going out at night would do so to go to clubs or party somewhere. Meaning people wouldn't exactly social distance.
@alyx i'm long past any ounce of assuming good faith from the state. 
@alyx well not exactly 'the state' but my good faith reservoir has run low as of late.
