One thing I disagree with is this:
"Rodriguez deemed Kelley 40 percent responsible for the crime"
To hold the person who committed the crime only 40% responsible due to the method he used to carry it out just seems stupid. Had he used a kitchen knife not a gun what would the percent be then ? There is no good way to determine these percentages and yet they are used to determine how hundreds of millions worth of taxpayer money will be spent.
