@tarperfume @grumpy @caskd @kallisti @rats @Flanker tracing real cp would cause the art to bear resemblance to a real-world sexual act which is demonstrably illegal
@tarperfume @grumpy @caskd @kallisti @rats @Flanker you seem to be disconnected from the fact that tracing over a five year old getting fucked in the ass is going to result in an identifiable likeness of that person
@opal @grumpy @caskd @kallisti @rats @Flanker ? no, i
i get that part. i'm just wondering if you want to talk about it being illegal or about why it shouldn't be done (other than it being illegal)
@prouddegenerate @opal @grumpy @caskd @kallisti @rats @Flanker talking about sexual drawings of children and the surrounding complications thereof
@prouddegenerate @opal @grumpy @caskd @kallisti @rats @Flanker yeah. not in that everyone is in agreement, mind, but yes, that is the topic at discussion
@opal @prouddegenerate @caskd @kallisti @rats @tarperfume @Flanker surely this time we'll be able to bring up arguments so compelling it will put the debate to rest permanently
@grumpy @opal @caskd @kallisti @rats @tarperfume @Flanker it's like no matter how many times it comes up we never say anything new or worthwhile

why's it keep coming back up
@prouddegenerate @opal @grumpy @caskd @kallisti @rats @Flanker there are new people all the time who are presumably having it for the first time
@prouddegenerate @opal @grumpy @caskd @kallisti @rats @Flanker i dont see all threads :p

i also just think you're being (understandably) cynical about this. retreading is important. i dont believe there is a single subject that has been fully exhausted
@prouddegenerate @opal @grumpy @caskd @kallisti @rats @Flanker idk. maybe. i'm not so much interested in changing minds as much as i am in learning and having arguments. i liked what i was talking about with opal before we both lost the thread of it
@tarperfume @prouddegenerate @grumpy @caskd @kallisti @rats @Flanker as an open anarchist, i bring up law, and somehow the conclusion was that i care about law. nah i care about staying out of prison
@opal @prouddegenerate @grumpy @caskd @kallisti @rats @Flanker i didn't conclude you cared about law, i was confused because you introduced "that would be illegal" without further explanation in a conversation that hadn't yet touched on the legal aspect!
@tarperfume @prouddegenerate @grumpy @caskd @kallisti @rats @Flanker
>without further explanation
because i had none to give, it was a standalone statement
@opal @prouddegenerate @grumpy @caskd @kallisti @rats @Flanker i see. my confusion came from the expectation that it was specfically related to the post it was quoting as an answer
@tarperfume @prouddegenerate @grumpy @caskd @kallisti @rats @Flanker the thread started with someone thinking shotacon is illegal so i think it's more than fair to clarify that imagery resembling a specific real-world minor is illegal regardless of whether it's drawn or photographed
@opal @grumpy @caskd @kallisti @rats @tarperfume @Flanker I guess, but if it's a regular picture of anime shotas being fucked is that illegal
Is that cp
@prouddegenerate @opal @grumpy @caskd @kallisti @tarperfume @Flanker

> is that illegal

my discovery is that in america /people have occasionally been sentenced for this/, but it seems to vary per state, and also on some weird contextual level that seems to depend on the squeamishness of the particular officials
@rats @opal @grumpy @caskd @kallisti @tarperfume @Flanker I think the consensus is that if the loli/shota is indistinguishable from a kid you could get charged with obscene content featuring a minor, which is why lolibooru and other places banned photorealistic 3dcg

but if you live in some place like texas and get busted with lolis you could possibly get in trouble there too
@rats @Flanker @caskd @grumpy @kallisti @opal @tarperfume there was a case in like 2008 where some guy was importing loli porn from Japan and he got caught, and the prosecution bullied him into admitting it was cp or indecent content featuring minors or whatever, so he got jail time and confiscations, so there's that

The fact that it's so vague and subjective and dependent on where you live really doesn't help the grey area of kodocon
@prouddegenerate @opal @grumpy @caskd @kallisti @tarperfume @Flanker

additionally there's the case of mike diana whose art style is weird/gross/alarming and is a massive fag so even though (to me) his art is deeply unerotic, people are a lot more willing to classify it as 'obscenity'
@rats @opal @grumpy @caskd @kallisti @tarperfume @Flanker yeah, obscenity is really vague, because anything I don't like or find gross can be marked as obscenity

Hell, a guy making comic book where a kid dies violently could be seen as obscene or something

I feel like the vagueness is on purpose
@prouddegenerate @opal @grumpy @caskd @kallisti @rats @tarperfume @Flanker obscenity is left vague so it can be determined relative to the community it is interfering with, when we had established obscenity laws they just used basic grounds like sexualised nudity or sexualised implications, immoral conduct (interracial, glorified/explicit violence), etc.
@prouddegenerate @Flanker @caskd @doorroo @grumpy @kallisti @opal @tarperfume

but yeah:

> Whether the average person, applying contemporary community standards, would find that the work, taken as a whole, appeals to the prurient interest.

so it's about if the community in general finds your porn freaky
@prouddegenerate @opal @doorroo @grumpy @caskd @kallisti @tarperfume @Flanker

yeah, it's weird - freedom of speech/expression feels v invested in protecting minority positions except for specifically those dealing w/ sexuality. i think it's prob a kind of a freudian way of thinking about the libidinal drives of ppl being especially prone to compelling ppl into antisocial behavior if they were corrupted maybe
@rats @opal @prouddegenerate @doorroo @grumpy @caskd @kallisti @tarperfume @Flanker
> freedom of speech/expression feels v invested in protecting minority positions
tfw several minorities are not harassed into the shadows unable to publicly speak their opinions
tfw minority positions are apparently defended by free speech larpers

did I sleepwalk into upotia?
@cafkafk @opal @prouddegenerate @doorroo @grumpy @caskd @kallisti @tarperfume @Flanker

i meant as far as like legal precedent is concerned but ill admit that i can never tell how good my understanding cuz maybe theres a bunch of cases i havent heard about
@rats @opal @prouddegenerate @doorroo @grumpy @caskd @kallisti @tarperfume @Flanker

Need.... Coffee !!!!
@cafkafk @Flanker @caskd @doorroo @grumpy @kallisti @opal @prouddegenerate @tarperfume

but

> notably for prohibiting classroom instruction on sexual orientation or gender identity from kindergarten to grade 3 in Florida's public school districts

yeah, florida seems to really hate gay people expressing themselves, that's p clearly the main reason mike diana got the book thrown at him so insanely fuckin hard by florida guys
