On April 11, 2022, Tate's house in Pipera, Romania was raided by the police after the U.S. embassy alerted them that an American woman might be held at the property. Two women were found at the property who claimed they were being held there against their will, sparking a DIICOT investigation into human trafficking and rape.
On December 29, 2022, Tate's villa was raided again, as well as the house of a former policewoman suspected of being involved. The police were partly tipped off by Tate's response video to Thunberg on Twitter which contained a Romanian pizza box, and proved his presence in Romania. Prosecutors stated that they had found and identified six women who were being "sexually exploited" by the suspects in various locations throughout Bucharest. Tate, his brother, the former policewoman, and an unnamed fourth Romanian individual were arrested. They have been charged with human trafficking, rape, and forming an organized criminal group, having been accused of "forming an organized criminal group that used girls for adult videos". Authorities claim that this criminal group was distributing pornographic material featuring these women for a profit, uploading them to profile sites, especially OnlyFans.

Not necessarily. It happens all the time over here, that while the case is being prepared to head to court, the criminal is released if it is believed he is not an immediate threat to society and there's a low likelihood of him running away.
It is true that, considering the supposed charges, that shouldn't qualify for him, but until we have more details, don't jump to conclusions.
