It's going to be very hard to argue against that.
No different than painting or 3D moddeling something yourself.
In either case it's unenforceable.
And if it's not spread around, it can't even be mistaken for real people that might coincidentally look similar to the generated image.

Another aspect to this is government overreach.
The governments could easily just plant that in your house while going through your things during a search.
So that might be another part of the reasoning behind the "it's fine as long as it isn't spread around".
