I have never seen someone use the "there are consequences for speech" defense in legitimate cases. It's why I hate it so much. It is always used to defend human rights violations, unethical behavior and poorly written ToS or laws.

You are not allowed to say "damn near anything anywhere". You cannot legally espouse communism in South Korea. You can't criticize the king in Thailand. China will haul your ass to the gulag for Winnie the Pooh jokes. Try being openly gay in Chechnya. Try making a joke in the UK.
