The other big factor is that any new division need to include a bill of rights similar to the US constitution as a central bedrock, most importantly, the freedom of speech, firearm arms, due process and rights against illegal search and seizure. No one really cares about quartering troops.

This doesn't guarantee a free state (fucking China has freedom of speech in their constitution), but anything less can and will eventually lead to authoritarianism (and be sure, there will be many divisions that will explicitly ban misinformation).
