@coolboymew I think it will allow them to go after those making tutorials on how to hack it because it does say that you are not allowed to tamper with it.

It also says you can't reverse engineer the software even though that falls under fair use. I guess they could go after you if you document the changes of the ROM on TCRF or something.
The only way they can actually punish you is by taking you to court.
But THAT IS LEGAL in North America last I saw. I cannot think of anything more useless than an EULA honestly
I'm not even sure why it's legal for them to put stuff unauthorizing already legal stuff in the country
@coolboymew I don't think it automatically makes hacking the system illegal. It's probably a legal gray area like installing macOS on a non-Apple branded computer. I haven't seen this being tried in courts. Apparently, this is the same EULA Nintendo used on the NES and SNES minis and I've never heard of any court cases involving this.
If anything, it would probably allow Nintendo to go after modchips or kits that allow users to hack and mod their devices (the mere fact you made one is proof that you hacked their device). Nintendo tried to go after cheat devices in the past, so it doesn't really surprise me that Nintendo would try to do such a thing.
@coolboymew Also there is a disclaimer on the back of the box saying that you agree to the EULA by purchasing the system. I guess that's your "warning".
