Are we talking today's AI, or very futuristic AI? Cause AI has the potential to be unbiased, which could be a big benefit in such situations.

Sure, but we've seen over and over again that a biased detective or prosecutor can absolutely make up evidence to convict you, if that's where their bias leans to.

My answer would depend on how mature the AI is. If it were future AI, I'd pick it, but with current tech, if someone were to ask it if I were innocent, it would probably answer that I'm cheese.

For today, we don't have AI good enough, so it would have to be the detective.
