This misuse of the term may stem from misuse of the term "capitalism", where it is misused to refer to heavily regulated corporate monopolies that are exempt by government from free market forces. Capitalists refer to this are "Corporatism", and it is anti-capitalist because corporations and government intermix via regulation and subsidy. Corporations use regulations and intellectual property laws to create barriers to entry to the market, so that they do not have to compete.
When they become a government-enabled monopoly/duopoly, you get the outrageous practices we see, that could not exist in a free market where people could buy from someone less egregious instead.
