@xyfdi @matrix not a lawyer, but i don't think it is actually applicable to gameliberty. it seems like it is mainly focused on algorithm/advertising stuff, which gameliberty doesn't have either of, and the more serious shit seems to only apply to very large sites.

either way, glc is such a small fry that it likely wouldn't be a problem. they are way more hellbent on going after places like twitter/facebook/youtube/tiktok and large search engines.

@beardalaxy @xyfdi Yeah, most of the rules apply only to large platforms and afaik they don't plan on punishing them by blocking user access, but by fines based on revenue so even if we break some rules I don't see a way of making us comply.

Regarding the fines, if you have a small company unrelated to the instance you are running, would that be a way to get to you (if they wanted to)?

@matrix @beardalaxy The big question then is how content is seen as by the filters, is Loli CP according to Chat Control?

@xyfdi @matrix imo, probably not worth worrying about man, if it passes then we can maybe worry about it, but they have so much bigger fish to fry and worst case the instance goes bye-bye to the EU, absolute worst case the instance goes offline and you find another one :meru_shrug:

i honestly don't think chat control will actually pass though and again, DSA doesn't really affect gameliberty at all.

also someone can correct me if i'm wrong but the scanning they're doing is looking for actual CP not hentai, and that's what their database contains. i don't think i've heard of anyone getting false flagged over hentai even with stuff like google or apple scanning their emails/texts/cloud but they have for things like medical photos.

no governing body or company should be able to scan everyone's messages, especially not without a warrant, but even in the worst case scenario that it does pass and you are in the EU and are worried about sending/receiving loli on this instance and gameliberty does for some reason implement it, they'd have to have some other reason to go after you. that's not legal advice or anything but it's just what i surmise.

if what you're worried about is the server itself, like whether it gets shut down or not, again, it's not really worth worrying about. you could always hop on over to baest or something which is hosted in the US by a guy who lives in the US who has 0 risk of having any issues because of the EU. the fediverse isn't just one instance.

@beardalaxy @xyfdi Pretty much. GLC is hosted in the US so even if the EU's definition of CSAM includes cartoons I can just reply to them to get bend.
